Revolution Muay Thai is committed to providing high-quality training services and a safe, professional environment for all members. These Membership Terms and Conditions outline the rules, responsibilities, and conditions that apply to membership, including fees and payments, access to the facility (including 24-hour access where applicable), suspension and cancellation, and member conduct.
Throughout these Membership Terms and Conditions, the terms “Revolution Muay Thai”, “we”, “our”, or “us” refer to Revolution Fitness Australia Pty Ltd (RFA) (ABN 14 681 788 287).
GENERAL TERMS
You agree to pay your Membership Fees by Direct Debit or Upfront (paid in full).
You may cancel your membership during the “Cooling Off Period” and RFA will refund any upfront payments (pro rata) and any membership fees. RFA will deduct all of the following from the refund: Access Pass Fees; Casual Class Fees for each visit; and any personal training fees. Cancellation must be completed in writing by sending an email to info@revolutionmuaythai.com.au
Class Passes, Free Trials, and Casual entry passes give you access to our classes only; they do not give you access to the facility outside of classes.
Your Membership Agreement has a minimum Initial Commitment Period of 6 months (Direct Debit package), 3 months (Direct Debit package), or 1 month (Month-to-Month Direct Debit package) from your Membership Start Date depending on which contract you have selected. All Teens/Under 18s and Kids Muay Thai Direct Debit packages have a minimum Initial Commitment Period of 1 month from the Membership Start Date depending on which contract you have selected.
From time to time, Revolution Fitness Australia Pty Ltd may offer promotional or discounted memberships. Where a membership is commenced under a promotional or discounted offer, the minimum Initial Commitment Period applicable to that membership will be the period specified in the promotional offer or sale materials at the time of purchase. By entering into a promotional or discounted membership, you acknowledge and agree to be bound by the minimum term and conditions of that promotion as advertised, regardless of the standard membership terms. Promotional minimum terms override standard minimum terms where expressly stated in the promotion.
On completion of your Initial Commitment Period your membership will automatically renew for a further 4-week (also referred to as “1 month”) commitment period (“Ongoing Commitment Period(s)”) unless your membership is terminated, or you provide us with notice that you wish to cancel your membership when your Initial Commitment Period expires. We must receive this notice at least 7 days prior to the end of your Initial Commitment Period. Each Ongoing Commitment Period will begin on the first day after your previous Ongoing Commitment Period ends.
Upon your request, RFA may temporarily suspend your membership, but we must receive your notice at least 7 days prior to the start of the period you wish to freeze. You will not be able to use the Club while your membership is frozen. If you freeze your membership during the Initial Commitment Period, your Initial Commitment Period and the Initial Commitment Period end date set out in your Membership Application will be extended by the duration of your freeze period. Maximum Freeze Periods: during your Initial Commitment Period, the maximum freeze periods for each Direct Debit contract are as follows: 12-weeks on a 12-month contract, and 6-weeks on a 6-month contract. The Maximum Freeze Periods on Month-to-Month Direct Debit membership is 3-calendar months.
Your Membership Fees are fixed for the Initial Commitment Period. Upon the expiry of the Initial Commitment Period your Membership Fees will be updated to the Membership Fees then applicable at the Club at that time. This may result in an increase to your Membership Fees after the Initial Commitment Period. We will write to you at the email address you have provided at least 14 days prior to any Membership Fee increase. After the Initial Commitment Period, if you do not wish to accept an increase in your Membership Fees you may terminate your membership by notifying us in writing that you wish to cancel your membership. In this case, your membership will terminate at end of the current Ongoing Commitment Period provided that we receive your notice at least 7 days prior to the start of the Ongoing Commitment Period. If you do not terminate your membership, you will be required to pay any revised Membership Fees from the date from which the change becomes effective; your direct debit payments or credit card payments will be amended accordingly. All Membership Fees include goods and services tax (GST). We reserve the right to change your Membership Fees in line with any government taxes or GST rate changes, even if you are in your Initial Commitment Period.
You must pay your Membership Fees at time they fall due. You will not be allowed to access the Club if your Membership Fees are outstanding. We may need to adjust the availability of certain facilities the Club from time to time for the purposes of cleaning, repairs, upgrades, maintenance, special functions, holidays or unforeseen circumstances. If the Club is not available for more than 14 days in a row, you can ask us for a credit against your Membership Fees for the period that the Club is not available.
RFA reserves the right to assign or novate all existing payment agreements to a new payment provider. In the event that RFA or the Payment Provider assigns or novates the existing Payment Membership Agreements to a new payment provider, the Club or current Payment Provider may supply your personal information (including but not limited to your payment details) in accordance with this agreement and Privacy Policy.
You acknowledge that gym access hours and class timetables are subject to change without notice. Any updates to class schedules, gym access times, or temporary closures will be communicated via our social media channels and/or in-gym notices, and it is your responsibility to stay informed of these updates. You are personally responsible for all Membership Fees due to us for yourself and/or any under-18 persons you are signing these terms on behalf of. Your Membership Fees are payable for the whole of your Initial Commitment Period at the total cost set out at the time of your payment authorisation. Your Membership Fees are due for the whole of each Initial Commitment Period and Ongoing Commitment Period(s) even if your membership is terminated during that Ongoing Commitment Period.
RFA is not liable to you for any personal property that is damaged, lost, or stolen from the Club. RFA is not liable to you for any personal property that is damaged, lost or stolen whilst on or around the Club including but not limited to any items left in the change rooms, or a vehicle parked in the car park or on the street (nor its contents). If you cause damage to the Club or its equipment you are liable to RFA for its cost of repair or replacement.
You acknowledge that CCTV is used for safety and compliance purposes only and is not actively monitored in real time.
MEMBERSHIP CANCELLATIONS
Memberships commenced under any Promotional Period or discounted offer are subject to a minimum sale period equal to the length of the promotion. Cancellation requests will not be accepted during this period. For the avoidance of doubt, any discounted, bonus, or incentive-based membership offer (including but not limited to half-price periods, free weeks, or bundled inclusions) constitutes a Promotional Period. Any notice to cancel may only be given once the promotional period has ended, at which point standard notice requirements will apply. This clause does not affect your statutory cooling-off rights.
You may cancel your membership at any time after your Initial Commitment Period or Promotional Period by advising us in writing that you wish to cancel your membership. We must receive this notification at least 7 days prior to the date from which you want your 1-month’s “Cancellation Term” to be effective. If we don’t receive your notification at least 7 days prior your next Weekly Billing Period, your Cancellation Term will commence after the following Weekly Billing Period.
If you wish to cancel your membership prior to the completion of your Initial Commitment Period or Promotional Period, you may do so by advising us in writing that you wish to cancel your membership early. Early termination will incur an “Early Termination Fee”. Early Termination Fees are 50% of your remaining membership that are due within the Initial Commitment Period. Your cancellation will not be processed until these fees are received by the Club. Your termination will take effect from the first weekly direct debit date after we receive notice of your wish to cancel your membership plus your Early Termination Fee.
You may cancel your membership during your Initial Commitment Period upon any of the following occurring: you are unable to use the Club because of a genuine and serious illness or injury (you must provide reasonable professional evidence of your illness or injury such as a doctor’s certificate or a letter from a hospital which specifically outlines how your condition prevents you from using the Club); you become bankrupt and provide us with reasonable evidence such as copies of Court documentation or orders; you relocate to an area not within 30 kilometres of the Club; we change the physical location of you the Club to more than 10 kilometres from its current location; or we close the whole of the Club for any reason for a period of 30 days in a row or longer. When cancelling your membership for ANY of the exceptional circumstances listed above, you must notify us in writing (by post or email) or advise one of our staff members in person. Your membership will terminate at end of the current weekly Billing Period provided we receive your notice at least 5 days prior to the start of the next weekly billing date.
RFA will cancel your membership where 3 consecutive Weekly Billing Period debits fail, and you agree to pay for all costs incurred by RFA (including costs for which the RFA may be contingently liable) in any attempt to collect any monies owed by you to RFA under this Agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis. RFA may terminate your membership immediately if: you commit a serious or repeated breach of these terms or the Club Rules; any part of your Membership Fees remains unpaid 28 days after falling due; or you provide us with details which you know to be false when applying for membership and these false details may have affected our reasonable decision to grant you membership. If we terminate your membership for any of these reasons, we may recover any other reasonable costs and expenses we incur as a result of your breach and collect the full amount of Membership Fees, any arrears and any applicable Early Termination Fee. You agree to pay for all costs incurred by RFA (including costs for which the RFA may be contingently liable) in any attempt to collect any monies owed by you to RFA under this Agreement including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.
24-HOUR ACCESS & NON-STAFFED HOURS
Access Passes (or FOBS) are issued to members upon agreeing to these Membership Terms and may be included as part of a promotional offer or otherwise charged separately at RFA’s discretion.
Your Access Pass gives you access to the ground floor gym and fitness areas (not including any upstairs Recovery facilities) during approved access hours as determined by RFA, including staffed and authorised non-staffed hours. You will be charged a replacement fee if your Access Pass is damaged or lost and requires replacing. It is your responsibility to inform Revolution Muay Thai by email of any loss of Access Pass at the first available opportunity. You must not enter the upstairs area at any time unless supervised by a member of staff.
Where 24-hour gym access is available, you acknowledge that use of the gym during non-staffed hours is entirely at your own risk.
During non-staffed hours you acknowledge that: no staff supervision is provided, you are responsible for your own safety and conduct, sparring of any kind is strictly prohibited (for the avoidance of doubt, while sparring may be permitted during staffed classes, sparring of any kind is strictly prohibited during non-staffed hours regardless of experience level), the coaching, instruction, or structured training of members by other members (excluding incidental assistance such as spotting or basic safety guidance) is strictly prohibited, and you acknowledge that during non-staffed hours, you are solely responsible for contacting emergency services (000) in the event of any injury, illness, or emergency
You acknowledge and accept full responsibility for any injury, loss, or damage sustained while using the gym during non-staffed hours, except to the extent required by law. Failure to comply with 24-hour access rules may result in suspension or cancellation of membership.
Access to the Club is strictly limited to individuals who have been issued their own authorised access pass by Revolution Muay Thai (RFA). Only the individual assigned to an access pass may use that pass to enter the premises. You must never allow any other person to enter the Club using your access pass, including but not limited to non-members, casual visitors, trial participants (paid or unpaid), guests, children under the age of 17 years, or other paying members who do not have their own access pass at the time of entry.
You must not hold doors open, allow tailgating, or otherwise facilitate entry for any other person, regardless of whether that person states they are a member or known to you. If you breach this clause, you: accept full responsibility and liability and indemnify RFA against any injury, loss, or damage suffered by the unauthorised person, whether or not caused by the negligence of RFA; acknowledge that an automatic fine of $150 will apply for each breach, which may be deducted from your nominated bank account (if paying by direct debit), invoiced to you, or deducted from any unused portion of prepaid membership fees; and
acknowledge that RFA reserves the right to immediately suspend or terminate your membership without refund. This clause applies at all times and is enforced most strictly during non-staffed hours.
PARENTAL SUPERVISION & RESPONSIBILITY (CHILDREN AND TEENS)
Where a Participant is under the age of 16 years, the Participant may only take part in Kids or Teens Muay Thai classes that are specifically designated for their age group and conducted under staff supervision.
Revolution Fitness Australia Pty Ltd (RFA) does not provide child-minding or general supervision services outside of structured Kids or Teens classes. Parents and/or legal guardians remain solely responsible for the care, supervision, conduct, and welfare of their child at all times while the child is on RFA premises, including before and after classes and while waiting in common areas.
Children must not enter training areas, use equipment, or remain on the premises outside of their scheduled class time unless directly supervised by a parent, legal guardian, or authorised staff member.
Parents and/or legal guardians acknowledge and accept that participation in Muay Thai and related athletic activities carries inherent risks, and they assume full responsibility for any injury, loss, or damage suffered by their child, except to the extent required by law.
Parents and/or legal guardians agree to ensure their child follows all Club Rules, safety instructions, and staff directions. RFA reserves the right to remove a child from participation or refuse entry where behaviour is unsafe, disruptive, or non-compliant, without refund.
Children and teens are strictly prohibited from accessing the gym during non-staffed hours or using 24-hour access facilities under any circumstances.
DISRUPTIVE BEHAVIOUR
Participants involved in any FHMAA offered by RFA will not display destructive, abusive or discouraging behaviour towards RFA, RFA’s equipment & property, members, volunteers, patrons, the general public, officers, officials, and referees. RFA reserves the right to: terminate any membership or participation in any of the above listed events, classes, programs, FHMAA offered by RFA; and/or refuse entry to any person engaging in such behaviour. Any language or behaviour that is deemed offensive, abusive, derogatory or detrimental to another member, RFA, or visitors may result in: the termination of membership or participation; revocation of right of entry of RFA’s premises, at the sole discretion of RFA.
PHOTOGRAPHY / VIDEOGRAPHY /AUDIO
Participants involved in any activities FHMAA conducted by or on behalf of RFA may be photographed, audiotaped or videotaped during training, in competition, outside of and within the gymnasium by RFA. By signing this Agreement, you consent to the use of these photographs and / or videos without financial or non-financial compensation of any kind, on any website of RFA or a related entity in any editorial, instructional, promotional or advertising material produced and / or published by RFA, and you agree not to photograph, audiotape or videotape any person within RFA’s premises without the prior written consent of RFA.
Terms & Conditions Updates
RFA reserves the right to amend these Terms and Conditions from time to time. Any amendments will be communicated to members via email, the RFA website, or in-gym notice. Continued use of the facilities after the effective date of any amendment constitutes acceptance of the updated terms.
